2. Data processed
Contact and appointments: name, email, phone, topic, commune, preferred date and time, message and acknowledgement of the data-protection notice. Valuation: property type, commune, area, land, condition, year, energy class, features and optional contact details. AI chat: language, messages and useful recent context. Security: the IP address is used transiently to derive a pseudonymised abuse-control key; it is not written to request or valuation files.
For security and stability, web-server logs may contain: IP address, timestamp, requested URL, status and browser details; verified retention: 1 days.
3. Purposes and legal bases
Contact, appointment and callback requests and follow-up of a valuation: responding to your initiative and preparing a possible contractual relationship (Art. 6(1)(b) GDPR). Running the estimator without contact details, minimal technical logging, security, abuse prevention and reliable request administration: ECK’s legitimate interests in providing and securing the service (Art. 6(1)(f) GDPR). Non-essential cookies or services, if later added: prior consent (Art. 6(1)(a) GDPR). Incoming requests are not ranked or filtered by AI.
User-initiated ECK Assist chat: provide the requested initial guidance and, where relevant, prepare a contractual relationship (Art. 6(1)(b) GDPR). Securing the chat and preventing abuse rely on ECK’s legitimate interests (Art. 6(1)(f) GDPR).
4. Recipients, AI and transfers
Recipients where necessary: ECK Immobilière, Gandi SAS (hosting, France) and the production email provider (Gandi SAS (France)). No data brokers or advertising use.
For ECK Assist and multilingual drafts, ECK sends only necessary content to Anthropic Ireland, Limited, Anthropic’s contracting entity for customers in the EEA and ECK’s processor. Processing and international transfers are governed by Anthropic’s Data Processing Addendum (DPA) and, where required, the EU Standard Contractual Clauses. Data is stored in the United States; unless otherwise agreed or instructed, traffic may be routed through infrastructure in the United States, Europe, Asia or Australia. A copy of the safeguards may be requested from contact@eck-immobiliere.lu.
Fable 5 model-specific rule: the provider currently requires 30-day API retention and does not make this model available under zero data retention. ECK activates it only after that condition has been explicitly approved. Provider terms.
Regardless of the model’s standard retention period, Anthropic states that inputs and outputs flagged by its trust-and-safety systems may be retained for up to two years and associated classification scores for up to seven years; legal retention requirements may also apply.
No decision based solely on automated processing produces legal or similarly significant effects. AI-prepared text is a draft subject to ECK’s editorial review. Do not send sensitive data in the chat.
5. Required and optional data
Fields marked * are required to handle the request; without them ECK cannot reply or confirm a time. Phone, commune and other unmarked details are optional. The valuation can be viewed without contact details; if you enter them, the data protection notice must be acknowledged before submission.
6. Retention
Requests and valuations stored by the site: deletion period of 730 days after collection; due records are removed during the next daily purge. Abuse-control keys: one-hour window. No persistent IP identifier in request files. Language cookie: one year; CSRF cookie: one day. Any later contractual, accounting or due-diligence records follow their separate legal periods. Email copies, backups and AI data follow the separate periods stated in this notice for each processing activity.
Production implementation: Website-request copies in the mailbox: 730 days; backups: 14 days; documented deletion procedure active.
Pseudonymised abuse-control keys stop being valid after one hour. Expired entries are removed on the next protected request and by daily maintenance; the scheduled job must be active in production.
7. Your rights
Where the legal conditions apply, you may request access, rectification, erasure, restriction and portability and object to processing based on legitimate interests. Where consent applies to an optional service, it may be withdrawn without affecting prior lawfulness. Contact: contact@eck-immobiliere.lu. You may lodge a complaint with the CNPD. cnpd.public.lu.
